The regular meeting of the Daggett Board of Education was held in Room 6 of district office building on March 14, 2007. Vice President Steen called meeting to order at 6:05 P.M. Also attending were members Olsen, Barber, Pallesen and President Asbill by phone; Superintendent Northcott; Business Administrator Robinson; Principal Taylor and Vice Principal Schell; Dot Coombs, Gretchen Northcott, Dusty Ercanbrack, Nina Beck, Kali Hughes, Kodee Schell, Lacy Larsen and Ashley Straatman.
Mr. Asbill moved that the minutes of the February 14, 2007 meeting be approved as written, seconded by Mr. Olsen, motion carried.
Mr. Olsen moved to approve this month’s warrants and payroll in the amount of $217,678.91, and approve the financial statement, seconded by Mrs. Barber, motion carried.
The Manila FFA Chapter participated in the Snow College Field Day this past October where the Land Judging team won the state contest and the Range Judging team placed second. Each state is allowed to send the five top teams in each division to the national competition in Oklahoma. Mr. Schell requested out-of-state travel for these two teams to travel to Oklahoma City on May 1-3, 2007. This is the first time they have ever had a Range Judging team qualify for national competition. In the past money used to send these teams to national competition has come from funds generated through Skills Certification. Because the FFA sent two teams to Indianapolis last fall those funds have already been spent. Mr. Olsen moved to approve the out-of-state travel with the intent that these teams raise as much money as they can to help pay the cost. Motion was seconded by Mrs. Pallesen, motion carried.
The Daggett County Economic Development Board will be holding its third annual Tower Rock Run this year on July 7, 2007. This activity is sponsored to bring visitors to the county and publicize our area more. Gretchen Northcott, the race director, requested the Recreation Board help out again this year by providing buses and drivers to transport participants to the starting point in Sheep Creek Canyon. Busing the participants provides safe transportation and reduces the amount of traffic in the area. Mrs. Barber moved that we donate the buses and drivers as in the past for the Tower Rock Run, seconded by Mr. Olsen, motion carried.
Mr. Olsen moved to approve the policies in Article I Board Governance with the exception of Policy #1140 – Board Members: Code of Ethics and Duties and Policy #1620 – Administrative Personnel: Evaluation. Making modifications to Policy #1600 – Administrative Personnel on the 3rd and final reading. Motion was seconded by Mrs. Pallesen, motion carried.

Discussion was held on calendars for school years 2007 to 2010. The “Fall Day” on each calendar will be flexible to accommodate hunting. Mrs. Pallesen moved to approve the following school calendars, seconded by Mrs. Barber, motion carried. . Mr. Asbill asked about moving the semester break closer to the Christmas break. Superintendent Northcott noted that he had tried that concept and it didn’t work well because it is unpopular among faculty because it forces a mid August start. Supt. also suggested that the high school schedule homecoming on the last week of the first semester.

Superintendent Northcott made the modifications he was asked to do on Policy #1140 – Board Members: Code of Ethics and Duties. Mr. Olsen moved to approve Policy #1140 on the 2nd Reading, seconded by Mrs. Barber, motion carried. Mr. Olsen moved to amend the main motion and strike the resolutions in Policy #1140, seconded by Mrs. Barber, motion carried. Motion as amended carried.

1. Obligations
As an individual board member:
1.1. I will be a staunch advocate of free public education.
1.2. I will uphold and enforce all laws, state board rules and regulations and court orders pertaining to schools. Desired changes should be brought about only through legal and ethical procedures.
1.3. I will make decisions in terms of the educational welfare of children and will strive for public schools which can meet the individual needs of all children regardless of their ability, race, sex, creed or social standing.
1.4. I will join with my fellow members on the board, the staff, the community and the students in continuing study of the nature, value and direction of contemporary education in our society in order to facilitate needed change in our schools.
1.5. I will work unremittingly to help the people of my community understand the importance of public education and the need to support it.
1.6. I will strive to ensure that people are accurately informed about our schools, and I will try to interpret to the staff the aspirations of the community for its schools.
1.7. I will recognize that my responsibility is not to run the schools, but, together with my fellow board members, to see that they are well run.
1.8. I will confine my board action to policy making, planning and appraisal, and I will help to frame policies and plans only after the board has consulted those who will be affected by them.
1.9. I will arrive at conclusions only after discussing all aspects of the issues at hand with my fellow board members assembled in meeting.
1.10. I will recognize that authority rests with the whole board assembled in legally authorized meetings and will make no personal promises nor take any private action which may compromise the board.
1.11. I will refuse to surrender my independent judgment to special interest or partisan political groups or to use the schools for personal gain or for the gain of friends.
1.12. I will hold confidential all matters pertaining to the schools which, if disclosed, would needlessly injure individuals or the schools.

1.14. I will vote to appoint, upon proper recommendation by the appropriate administrative officer, the best trained technical and professional personnel available.
1.15. I will support and protect school personnel in proper performance of their duties.
1.16. I will refer all complaints to the chief administrative officer and will act on such complaints at legally authorized meetings only after failure of an administrative solution.
2. Competency
2.1. Personal Improvement: School board members shall continually seek to improve their mental skills, including study, preparation and planning to enable themselves to better serve their communities.
2.2. Involvement: The Board and all its members shall be involved and knowledgeable about not only local community education concerns, but also state and national concerns and shall know and be aware that involvement beyond the local community is essential to a strong and productive public educational commitment.
3. Basic Principles and Procedures
3.1. Policies: Shall be in written form and reviewed regularly by the Board.
3.2. Administrative functions: Shall be delegated by the Board to the Superintendent or other appropriate administrative staff.
3.3. Goals: Shall be adopted, evaluated and reviewed on a regular basis by the Board with advice of the Superintendent.
3.4. Evaluation of staff: A procedure shall be established for the evaluation of performance of all staff; the Board’s primary concern should involve the Superintendent; and the Superintendent’s primary concern should be his or her subordinates.
3.5. Communications: Shall be encouraged with all parts of the community.
3.6. Complaints: Shall be acknowledged and received by the Board with procedures devised to resolve them.
3.7. Professional growth: Shall be encouraged by the Board for all its staff; including in-service training.
3.8. Fiscal responsibility: Shall be adhered to and any budget to be adopted shall not result in a deficit, unless permitted by the law.
3.9. Civil rights: Shall be upheld, and the concept of affirmative action shall be encouraged.
3.10. Student rights: Shall be recognized without discrimination and in accordance with due process of law.
Mrs. Pallesen moved to approve Policy #1620 – Administrative Personnel: Evaluation as amended on the 1st Reading, seconded by Mr. Olsen, motion carried.

1.1 The District participates in the Uniform School Fund, which the State Board of Education apportions annually among school districts according to the provisions of the Minimum School Program Act.

1. Borrowing in Anticipation of Taxes
1.1 The Board may borrow money in anticipation of the collection of taxes or other revenue of the School District so long as it complies with the Utah Local Government Bonding Act.

2. Indebtedness Purposes and Limitations
2.1 The Board may incur indebtedness for any purpose in the interest of education but shall not incur any indebtedness in excess of the estimated District revenues for the current school year.

3. Voting to Incur Bonded Indebtedness
3.1 The Board may in conformance with the Utah Local Government Bonding Act require, by a majority vote of the Board members, that the qualified voters of the District vote on a proposition as to whether to incur indebtedness by bonding, provided that:
3.1.1 The debts of the District are equal to school taxes and other estimated revenues for the school year; and
3.1.2 Either of the following is determined by the Board:
3.1.2.1 Additional indebtedness must be incurred by the District to maintain and support schools in the District; or
3.1.2.2 It is advisable to issue school district bonds to purchase school sites, buildings or furnishings or to improve school district property.

4. Refunding Bonds
4.1 If the Board determines that it desires to refund bonds, it shall follow the following procedure to determine the validity of the bond or bonds:
4.1.1 The Board shall have published once a week for two successive weeks in a newspaper published in the District, or if there is no such newspaper, post for a like period in three public and conspicuous places in the District, a notice which satisfies the following requirements:
4.1.1.1 It describes with sufficient particularity for identification the bond or bonds intended to be refunded.
4.1.1.2 It requires any person objecting to the legality, regularity, or validity of the bonds, their issue or sale, or the indebtedness represented by the bonds, to appear before the Board at a specified place within the District on a specified day and time.
4.1.1.2.1 This time may not be less than 14 nor more than 60 days after the first publication or posting of the notice.
4.1.1.3 It requires the person to appear at the meeting with his objections in writing, duly verified.
4.1.2 The Board shall convene at the time and place specified in the notice and receive all objections which satisfy the requirements of the notice.
4.1.3 The objections shall be filed with and preserved by the Board.
4.1.4 If no written objections are presented at the time and place specified in the notice, the Board shall so certify and the Board may then refund the bonds.
4.1.5 Any person filing a written objection as stated above has 20 days to commence appropriate legal proceedings against the Board and others as may be proper parties, in the district court for the county in which the school district is situated, to challenge and determine the legality, regularity, and validity of the bond or bonds, their issue and sale, or the indebtedness represented by them.
4.1.6 If a person filing a written objection fails to commence legal proceedings against the Board within 20 days, and that failure is established by a certificate of the clerk of the court, the challenge to the legality, regularity, or validity of the bond or bonds, their issue or sale, or the indebtedness represented by the bonds is barred, and the Board may refund the bonds.

1. Local School Foundation
1.1 The District may with Board approval establish a local educational foundation to assist in developing and implementing programs to promote educational excellence and assist in accomplishing other educational objectives.

2. Powers of Foundation
2.1 A local educational foundation established by the District:
2.1.1 May solicit and receive contributions from private enterprises earmarked for use in the foundation’s programs to promote educational excellence;
2.1.2 May not incur contractual obligations or liabilities which in any way constitute a claim against the school district’s funds;
2.1.3 May not exercise executive, administrative or rule making authority over the programs except to the extent specified by the Board;
2.1.4 Is exempt from all taxes levied by the state or any of its political subdivisions with respect to any activity undertaken to promote or undertaken in connection with promotion of educational excellence.

1. School Board Budget
1.1 Prior to June 22 of each year, the Board shall adopt a budget and make appropriations for the next fiscal year.

2. Tax Rate
2.1 If the tax rate in the proposed budget exceeds the tax rate defined in Utah Code Ann. § 59-9-924, the Board shall comply with the provisions of Utah Code Ann. § 59-2-918 and Utah Code Ann. § 59-2-919, unless one of the exceptions to these provisions (relating to prior voted leeway increases) set forth in Utah Code Ann. § 53A-17a-133 applies.

3. Adoption of a Budget
3.1 Prior to adoption of a budget, the Board shall hold an open, public hearing on the proposed Budget. In preparation for the hearing, the Board shall:
3.1.1 Publish notice that the Board will consider and adopt a budget at the designated Board meeting in a newspaper of general circulation within the District at least one week prior to the meeting; and
3.1.2 File a copy of the proposed budget with the Business Administrator for public inspection at least ten days prior to the hearing.

4. Filing Budget
4.1 The Board shall file a copy of the adopted budget with the state auditor and the State Board of Education.

5. Undistributed Reserve
5.1 The Board may place an undistributed reserve in the budget that does not exceed 5% of the maintenance and operation budget.

6. Application of Undistributed Reserve
6.1 The Board may appropriate all or part of the undistributed reserve made to any expenditure classification in the maintenance and operation budget by a written resolution adopted by a majority vote of the Board. The resolution shall state the reasons for the appropriation. A copy of the resolution shall be filed with the State Board of Education and the State Auditor.

7. Restrictions on Use of Undistributed Reserve
7.1 The Board may not use the undistributed reserve in the negotiation or settlement of contract salaries for District employees.

8. Limit on Appropriations
8.1 The Board shall not make any appropriation in excess of the District’s estimated expendable revenue, including undistributed reserves, for the following fiscal year.

9. Reduction of Budget Appropriations
9.1 The Board may reduce any budget appropriation at its regular meetings if notice of the proposed action is given to all Board members and the Superintendent at least one week prior to the meeting.

10. Increase in Budget Appropriations
10.1 The Board may increase any budget appropriation only if:
10.1.1 The Superintendent in writing requests the Board to increase a specified budget appropriation and states the reasons for the proposed increase;
10.1.2 Notice that the request will be considered by the Board is published in a newspaper of general circulation at least one week prior to the Board meeting at which the request will be considered; and
10.1.3 The Board holds a public hearing on the request prior to acting on the request and approves the increase by a majority vote of Board members.

11. Prohibition of Interfund Transfers
11.1 District revenues shall only be spent within the fund for which those revenues were originally authorized, levied, collected, or appropriated, and interfund transfers of residual equity may not be made unless expressly authorized by the State Board of Education.

Fiscal Policies for Schools
1. Fiscal Policies
1.1. Each school shall have one bank account. Each school shall deposit revenues as often as deemed necessary but not less than monthly.
1.2. Deposits should be made as soon as;
1.2.1. The elementary schools on-hand balance exceed $500.00;
1.2.2. The high school on-hand balance exceeds $1,000.00.
1.2.3. All money received shall be properly receipted and documented and a permanent record kept for future reference.
1.3. Teachers collecting funds from students for book orders, shop projects, athletic supplies, fund raisers et cetera, will remit those funds to the school secretary for deposit into the school account. No clubs, student classes, or student organizations under the direction of Daggett School District may maintain separate bank accounts for those organizations.
1.4. No student, employee, or other person shall be allowed to borrow, give a post-dated check or an I.O.U. in exchange for school funds.
1.5. All disbursements shall be made by check. Copies of original invoices shall be marked paid with check number indicated and filed alphabetically. Two signatures shall be required on all checks issued from school funds. The school secretary and/or the principal shall be responsible for a monthly bank reconciliation and a financial accounting of each individual account showing receipts and disbursements. Financial accounting of individual schools shall be audited yearly by the business administrator of the district or independent auditor.

DISPOSAL of SURPLUS SCHOOL PROPERTY
1. Disposal
1.1. When it is determined that school equipment is no longer serviceable, written notice shall be provided by the proper school administrator and sent to the superintendent after which it shall be sent to the government agency dump site and the proper record made of the property disposal. School employees shall not have salvage rights to this equipment.
1.2. When serviceable school equipment, furniture, or other items are determined to be in excess, they shall be made available to other schools in the district. If no need is found in another school, the items shall be sold at bid to the community at large. They shall be offered to other school districts or governmental agencies in the county or state. If no governmental agency indicates a desire to purchase surplus district property or if no bid is made on an article, it may be sold at a fixed price if there is an established procedure available to determine a “fair market value”.
1.3. The Superintendent of Schools and members of the school Board may not bid on any item.

Equipment Inventory
1. Equipment Inventory
1.1. All teachers are responsible for the equipment issued for their use. Each principal is responsible for the maintenance of the equipment and furnishings assigned to the building.
1.2. A record of all equipment valued at $500.00 or more and all items of a nonconsumable nature, will be maintained by the person in charge of that equipment, i.e. teacher, custodian, etc.
1.3. A physical inventory will be taken annually by the person in charge to verify the existence of the items and the validity of all descriptive data. These items will be listed on the inventory form provided by the district together with the condition of the equipment.
1.4. Deletions from the inventory list will be noted and accounted for.

Mr. Asbill moved to approve Policy #3xx3 – Employment: Background Checks as modified on the 3rd and final reading, seconded by Mr. Olsen, motion carried.
3XX3
1. Employee Background Checks
1.1. At the time a prospective employee makes application for employment with the District, such prospective employee shall fill out an employment application which provides the following warning:
“All references stated in this application will be checked by the School District and it is the policy of this School District that false information will be grounds for rejecting your application with no further consideration for the position; or, if such false information is discovered after hire, you will be subject to immediate termination for cause. Any false information may also be the grounds for criminal prosecution.”
1.2. All employees seeking employment with the District shall sign a written release, waiver and authorization which authorizes the District to request information from the prospective employee’s past three employers and supervisors. The release, waiver and authorization shall also authorize the District to contact former employers to obtain a reference check as the District deems necessary to satisfy itself of the quality and competence of the prospective employee’s credentials.
2. Criminal Background Check
2.1. The Superintendent or the Superintendent’s designee shall require any prospective employee, or volunteer who will be given significant unsupervised access to any student in connection with the employee/volunteer’s assignment or, where reasonable cause exists, a current employee or volunteer to submit to a criminal background check, and shall require the person to provide fingerprint identification for that purpose.
2.2. The applicant, volunteer or employee shall be given written notification that a background check has been requested. The Superintendent or Board shall consider only those convictions which are job-related.
2.3. The District will pay the cost of all background checks.
2.4. An applicant, volunteer or employee shall be extended an opportunity to respond to or explain any information received as a result of the criminal background check. If the District denies a person employment or terminates an employee because of information obtained through a criminal background check, the person or employee shall be given written notice of the reasons for denial or dismissal and extended an opportunity to respond to the reasons.
2.5. Information obtained pursuant to a criminal background check is confidential and may only be disclosed as provided in Policy 3xxx Personnel Files.

Mrs. Barber reported there was no UBATC meeting held this month.
Superintendent’s activity report was reviewed.
Superintendent Northcott asked for guidance regarding the lease of the Bennion Lane Property. Mrs. Pallesen would like more information as to the amounts of past leases, the cost of up keep etc.
Superintendent Northcott gave members a summary of the legislative bills regarding education.
Discussion was held regarding the Voter Referendum on Vouchers.

Superintendent Northcott noted the following Great Things Happening.
1. The GBB team finished the regular season with an exciting win over Tabiona. The girls finished 8-2 in league play and 16-4 in season play. With a cross-over win and great play at the state tournament (heartbreak loss to Tabiona in overtime), the team won 3rd place. We are very proud of their accomplishments. Congratulations to coaches Kim Stephens and Ben Wolford and all the girls.
2. Lacy Larsen was selected to the All-Tournament team, and as a Monroe Lions Club all-star. Deseret News all-state selections were Lacy -1st Team; Nina Beck - 3rd Team; and Kali Hughes Honorable Mention.
3. JHGBB teams finished their season. Congratulations to Coaches Toni Pendleton and Boyd Pallesen and the girls for their exciting season.
4. The BBB team finished their season but unfortunately failed to qualify for state. After a rest, the boys will begin preparations for next year.
5. New Activity seasons are upon us – golf, track, and drama have all begun practicing.
6. MES recently held a Snow Sculpture Contest that was fun and exciting for the students.
7. Brandon Schanno graduated from DSD Adult High School.
The USBA Regional meeting will be held on March 21, 2007 in Roosevelt @ 6:00 p.m.
The next Board work meeting will be held April 5, 2007 at 5:30 p.m.
Mr. Asbill will work on District Goal Setting and Board Evaluation.
